How these rates are set
Many of the levies that the Ministry for Primary Industries (MPI) collects have the levy rate set out in regulations, with any changes requiring Cabinet's agreement. The Cabinet process ensures that any rate changes proposed by MPI are subject to full public consultation and the scrutiny of Cabinet, to safeguard fee payers' interests. However, resetting rates through this process can take 6 to 9 months.
To ease this process, some levy rates are able to be changed by the Director-General (DG) of MPI based on a formula set out in regulations and up to a specified maximum rate (a cap). To change a rate the DG still must consult affected fee payers on the proposed change. Generally any changes made by the DG are notified in the New Zealand Gazette at least 30 days before the proposed new rate comes into effect. Overall, this process typically takes 2 to 3 months.
