A small winemaker can seek an exemption from the requirements to register a Wine Standards Management Plan (WSMP) under Regulation 19 of the Wine Regulations 2021 by notifying the Ministry for Primary Industries (MPI).

What is a wine standard management plan?

Wine businesses exempt from registering a wine standards management plan

Use this form to notify your small winemaker exemption to MPI for the first time, make changes, or cancel your exemption. 

The cost for a new notification or a renewal is $155.25 including GST. You can pay by credit or debit card or by direct credit. A tax receipt is available on request.

A month before your exemption ends, you will get an email with instructions on how to renew.

Note: Once you have an exemption, any wine made at your premises will not be eligible for export.  

The exemption is from registering a WSMP only. You still need to follow requirements under the Wine Act 2003. The best way to comply with these standards is to follow all relevant components of the WSMP code of practice.

To ensure compliance to exemptions, MPI does random audits of exempt winemakers.

If you no longer meet the criteria for the exemption, you must register a WSMP with MPI in accordance with section 16 of the Wine Act 2003.

Exemption criteria

Complete this section to confirm that you meet the exemption criteria in regulation 19 of the Wine Regulations 2021.

Note: The dates you have chosen above cannot occur before submitting this WA3 form to MPI. In other words, the exemption cannot be retrospective.

Applicant statements

In submitting this form, I confirm that:

  1. I am authorised to act on behalf of the company to notify MPI that the winemaker meets the exemption criteria outlined in regulation 19 of the Wine Regulations 2021, or I am a person with legal authority to act on behalf of such a person.
  2. The information supplied in this notification is truthful and accurate to the best of my knowledge.
  3. I am aware that the exemption is from Subpart 1 of Part 2 of the Wine Act 2003 only and that all other requirements of the Wine Act 2003 and its associated standards and requirements continue to apply.
  4. I understand that any wine made under this exemption will not be eligible for export.
  5. I understand that the winemaker must register a WSMP with MPI where the criteria for the exemption no longer apply.
  6. I agree to MPI publishing the name and physical address of the business that meets the exemption criteria.

In the reference details, put the word 'SWME' and your company name. Also include your NZBN (if you have one).

After you submit your application

Processing time is up to 20 working days from the time we determine that your application is complete. When your application has been approved by MPI, your business details will be published on the MPI list of exempted winemakers, to aid in the identification of those that meet the exemption criteria.
